Family Supports HCBS Waiver Overview
The Family Supports HCBS Waiver (FSW) is designed to offer non-residential, community-based services for individuals with developmental disabilities who live with their families or in other non-institutional settings. This waiver provides support services to help individuals maintain independence within their homes and communities, fostering an inclusive environment for growth and well-being.
Eligibility Requirements
To qualify for the Family Supports HCBS Waiver, individuals must meet specific Medicaid and HCBS waiver eligibility guidelines, including:
- A diagnosis of intellectual disability before the age of 22
- Residency in or transition to a non-institutional, HCBS-compliant setting
- Income no higher than 300% of the maximum Supplemental Security Income (SSI) amount (parental income for children under 18 is disregarded)
- Meeting the “ICF/IID level of care” criteria
What is ICF/IID Level of Care?
ICF/IID (Intermediate Care Facility/Individuals with Intellectual Disabilities) level of care ensures that an individual has substantial functional impairments similar to those experienced by people with intellectual disabilities. To meet the ICF/IID level of care, the individual must:
- Have a disability that significantly limits their ability to function in at least three major life areas, such as self-care, communication, learning, mobility, self-direction, and independent living
- Require access to 24-hour assistance as needed
- Have a condition that is expected to continue indefinitely and originates before the individual turns 22 years old

Additional Services for Waiver Participants
For individuals aged 21 and over, services like Speech/Language Therapy, Occupational Therapy, Physical Therapy, Intensive Behavioral Intervention, and Psychological Therapy may be included in the waiver budget once private insurance and Medicaid funding options are exhausted or denied.
